SCHOOL TEACHERS’ PAY 2002: PAYMENT OF £33 IN RESPECT OF THE GTC FEE
In Education Employers’ Bulletin No 457 dated 25 March 2002 we said we would offer further advice on the payment of the £33 lump sum in respect of the GTC fee. The advice below seeks to ensure that all eligible teachers employed under the terms of the School Teachers’ Pay and Conditions Document receive the payment whilst also ensuring that no teacher receives the payment twice.
Regularly employed teachers
It is recommended that regularly employed full-time and part-time teachers who are in employment on 1 May 2002 should be paid their £33 payment no later than with their May salary. Where such teachers are first employed on 1 September, the payment should be made by October. Where the first employment is 1 January, the payment should be made by February.
In general terms, new employers of regular full-time and part-time teachers who commence employment with them after 1 May and who have a continuous employment record should assume that these teachers have already been paid the £33 sum.
Part-time teachers employed in more than one school
Where regular part-time teachers are employed in more than one LEA or by more than one school – particularly where one or more of these schools do not use the LEA as the payroll provider – it will be necessary to avoid any possibility of double payment. It is recommended that in these instances the school where the teacher is employed for the majority of their time on 1 May should be responsible for instructing the payroll provider to make the payment, the payment to be made no later than with their May salary.
Where a regular part-time teacher is first employed on 1 September in more than one school, it is recommended that the school where the teacher is employed for the majority of their time should make the payment by October. Those first employed on 1 January should be paid by February.
Supply teachers
All qualified supply teachers are entitled to receive the £33. It has proved difficult to design a single, simple method to suit the variety of circumstances.
It is recommended that supply teachers who work during May should be paid the £33 sum as part of the payment for that period of work. It is recommended that the school where the teacher works for the majority of their time during May should be responsible for ensuring the payment is made.
It is recommended that each time a supply teacher commences employment with a new school or new employer after 1 May 2002 they should be asked to confirm whether or not they have already received the £33 payment.
It is assumed that at a certain date in 2002/03 – say 1 January 2003 – it will be reasonable to assume that an active supply teacher will have already received the £33 payment and that any new employer after this date would not be expected to check whether the supply teacher had already received the payment. The onus would be on the supply teacher to prove that they had not received a payment.
Administrative process
It is recommended that all teachers receiving the payment should be advised separately as well as by way of their normal monthly pay slip. They should also be advised that they are only entitled to receive the payment once.
For supply teachers in particular, the LEA may want to consider recording when a payment has been made so that if the teacher returns subsequently for another period of employment it is possible to identify him/her as someone who has already received the £33 sum. An LEA should consider sharing this information with neighbouring LEAs.
LEAs will want to liaise with foundation schools and voluntary aided schools in their area. LEAs may also want to consider liaising with private payroll providers who provide such services to schools in their area.
Governing bodies should be advised that they are under a duty to take reasonable steps to establish whether a teacher has been paid the £33 sum. LEAs are under an obligation to respond to requests for information from schools, including schools in neighbouring LEAs, in accordance with the provisions of the Education (School Teachers’ Pay and Conditions) Order 2002.
Status of payment
The Government is not providing any additional funding to LEAs or schools to cover the cost of making the payment.
The £33 payment is part of this year’s statutory order for teachers’ pay. The £33 payment is taxable, superannuable and liable to national insurance deductions. The payments are made to all qualified teachers, including leadership group members, regardless of how or whether fees are paid for membership of the GTCs. This covers all such teachers paid under the Document.
Since the £33 payment is part of a teacher’s pay entitlement effective from 1 April 2002, any teacher who retires from this date onwards (for example, on 30 April 2002) is entitled to be paid the £33. This payment will then be taken into account in any pension calculation.
For teachers in unpaid periods of service, the £33 should be paid when they resume paid employment. It follows that teachers on an LEA "supply register" will not be eligible for the payment unless they undertake a period of paid employment (of whatever length).
The classroom teachers’ scale for September 2002, revised to take account of the separate £33 payment, is attached. We are still discussing a number of points with the DfES on issues such as the assimilation arrangements for teachers returning to service after 1 September.

CONFIRMATION OF CHANGES TO TEACHERS’ PAY IN 2002-2003
The Secretary of State has confirmed that the teachers’ pay settlement from 1 April 2002 will be as follows:
An increase of 3.5% to all teacher pay scales and allowances. The Secretary of State has decided not to add £33 to all spine points to take account of General Teaching Council fees. Instead, relevant bodies shall make a single payment of £33 to teachers in respect of their registration with the General Teaching Council. The new pay scales and allowances effective from 1 April are shown below. It should be noted that because of the removal of the £33 originally proposed, these pay scales differ from the proposed rates issued in February.
It will no longer be a requirement that candidates for advanced skills teacher posts should have first passed the performance threshold.
The Secretary of State has also confirmed that with effect from 1 September
2002:
The main classroom teacher pay scale will be shortened to six points, starting at the current point 2.
Upper pay scale points will remain an entitlement when teachers transfer between schools, with no scope for voluntary forfeiture.
Relevant bodies will be able to change the individual school range (ISR) at any time in order to attract or retain a headteacher. They will also be able to set an ISR which extends beyond the school group maximum in order to retain an existing head.
Relevant bodies will have discretion to award two performance points in any one year to leadership group members.
Headteachers given a temporary ISR in certain circumstances – perhaps because they have been seconded to turn round a failing school – will be able to receive any performance award that relates to the temporary ISR as a lump sum when they return to their main post.
Two extra points will be added to the top of each school range, including the creation of extra spine points L42 and L43 to allow such an extension for group eight, in order to provide adequate scope for setting and reviewing ISRs.
Teachers reaching the top of the main pay scale in September 2002 will be eligible to apply for threshold assessment in autumn 2002 as well as teachers reaching the top of the pay scale in September 2001.
The April changes will be given legal force by the Education (School Teachers’ Pay and Conditions) Order 2002 which will shortly be available on the Stationery Office website at http://www.legislation.hmso.gov.uk/stat.htm#2002. They will also be incorporated in a revised version of the School Teachers’ Pay and Conditions Document 2001 which will be shortly be accessible at http://www.teachernet.gov.uk/pay.
Further adjustments will take effect from 1 September 2002. These will be set out in the School Teachers’ Pay and Conditions Document 2002 and guidance which will be made ready during the Summer term and will be sent to all schools. These publications and other details of teachers’ pay arrangements will be on-line at http://www.teachernet.gov.uk/pay.
The Department is committed to continue producing the teachers’ pay software – first produced in 2000 to aid assimilation to the new pay structure. From April it will be a website only version available on Teachernet at http://www.teachernet.gov.uk/pay. Full details will be announced shortly.
